Contractor Seeks Dismissal Of Moss Lawsuit

The general contractor for N.P. Moss Middle School has asked for a lawsuit filed against it to be dismissed.  Alexandria-based Ratcliff Construction contends too much time has elapsed between completion of the school's construction and the discovery of mold and water intrusion for the contractor and the architect to be held responsible.  Ratcliff cites a law that states a lawsuit must be filed within five years of the completion of construction of a public building for the contractors to be liable.  Construction of Moss Middle was completed July 15, 1999.  Lafayette Parish School Board attorney Paul McMahon has said an overall 10-year ceiling should apply to this case.  Judge Marilyn Castle has set a hearing date for October 20th.

FEMA Claims $2.2 Million Owed By Cajundome

(Lafayette, LA)  --  Lafayette City-Parish President Joey Durel says local officials will appeal the findings of a federal audit that show the Cajundome owes FEMA more than two million million dollars it received from the agency for housing Katrina and Rita evacuees.  The Cajundome received $8 million for sheltering thousands of evacuees, but FEMA wants the facility to repay $2.2 million it charged for usage fees, saying the money is not eligible for reimbursement.  The usage fees are intended to compensate for revenue lost because of cancelled events.  Lafayette Consolidated Government already plans to repay FEMA more than $1 million that was never spent on hurricane recovery.  Cajundome Director Greg Davis says FEMA recently paid 68-thousand dollars in usage fees upfront when the facility housed 500 FEMA personnel who were working in this area during hurricanes Gustav and Ike, and says the agency is being contradictory by denying usage fees associated with Katrina and Rita.

Iberia Parish Man Wanted For Murder

(New Iberia, LA)  --  Iberia Parish authorities are looking for a man wanted for second-degree murder.  Sheriff's deputies say 19-year-old Tyrail Gilliams should be considered armed and dangerous.  Officials say Gilliams is accused of fatally shooting another person on September 10th, during a confrontation in the parking lot of a business in the 500 block of West Admiral Doyle Drive in New Iberia.  Deputies describe Gilliams as black, with a thin build, about five-feet-nine-inches, with his top front teeth capped in gold.

Council Applicants To Be Interviewed

(Lafayette, LA)  --  The Lafayette City-Parish Council is set to interview seven people who have applied to become interim council member for District Six.  The position will become vacant with the departure of veteran Councilman Bruce Conque [[ konk ]] on October 1st to take a job with the Greater Lafayette Chamber of Commerce.  The closed-door interviews are scheduled for tomorrow evening, and a public comment period will take place afterward.

Property Owners' Assessment Appeals Denied

(Lafayette, LA)  --  Appeals by four property owners who contested the reassessed value of their properties were denied last night by the Lafayette City-Parish Council.  The appeals were filed following issuance in July and August of property reassessments throughout the parish.  The assessments are conducted every four years, and determine how much property taxes owners must pay.  Two property owners maintained their tracts are located in a flood plain, and their worth on the open market has diminished as a result.  Lafayette Parish Assessor Conrad Comeaux says 1996 flood maps were used for this year's assessments -- not the most recent preliminary maps, which are being challenged by local officials.  Comeaux says anyone not happy with the council's decision can appeal to the state Tax Commission.
